I studien undersöks huruvida barns legala status har betydelse för att uppnå skydd inom Sveriges jurisdiktion. Det analyseras även hur den svenska barnskyddslagstiftningen förhåller sig till europarätten samt barnkonventionens artiklar 2, 3 och 19. Avslutningsvis undersöks också hur barn till utsatta EU-medborgare bedöms i rättspraxis. Underlaget i studien består av fyra studerade domar från förvaltningsrätter och kammarrätter i Sverige som varit relevanta utifrån studiens frågeställningar. Studiens material analyseras utifrån en rättsvetenskaplig metod, där traditionell rättskällelära har kombinerats med rättsanalys för att förklara rättens innehåll och tolka lagstiftningen samt för att utreda eventuella oklarheter och inkonsekvenser i lagstiftningens utformning. Studien visar att socialtjänstens ansvar för att skydda barn utifrån deras legala status försvåras på grund av otydligheter i landets jurisdiktion, likaså att det finns skillnader i hur barn till utsatta EU-medborgare hanteras i rättspraxis, eftersom svensk och utländsk lagstiftning lämnar utrymme för tolkning. Studien visar även att den svenska barnskyddslagstiftningen i förhållande till barnkonventionens artiklar begränsas på grund av domstolens tolkning av barnets hemvist. Studiens slutsatser är att det råder otydligheter och oklarheter mellan svensk och utländsk lagstiftning. Konsekvensen av detta blir att barn som är i behov av skydd inte får sina grundläggande rättigheter respekterade då domstolens behörighet i Sverige är oklar och komplicerad, särskilt till följd av att det saknas vägledande avgöranden från högsta instans.

The study examines whether the legal status of children is important in order to achieve protection within Sweden’s jurisdiction. The study also analyzes how the Swedish child protection legislation relates to European law and the articles of the Convention of the Rights of the Child and if the regulations make a difference between children. Finally, we investigate how children of vulnerable EU citizens are dealt with in case law. The underlying component of the study consists of four studied cases from different administrative courts and courts of appeal in Sweden that were relevant to the study’s questions. The study material is analyzed on the basis of a jurisprudence method in which traditional legal sources have been combined with legal analysis to explain the content of the law and interpret the legislation as well as to investigate possible ambiguities and inconsistencies in the design of legislation. The study shows that the social services’ responsibility for protecting children based on their legal status is complicated due to ambiguity in the country’s jurisdiction, as well as differences in how children of vulnerable EU citizens are handled in case law, as Swedish and international human rights law leave room for interpretation. The study also shows that the Swedish Child Protection Act, in relation to the articles of the Convention on the Rights of the Child, is limited by the Court’s interpretation of the child’s domicile. The study’s conclusions are that there are ambiguities and imprecisions between Swedish and foreign legislation. The consequence of this is that children in need of protection will not have their fundamental rights respected since the jurisdiction of the Court in Sweden is unclear and complicated, as there are no guiding rulings from higher judicial authorities.
